TERMS AND CONDITIONS OF USE AND SALE

1. Acceptance of Terms

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, “your”) and Arjun Nirvana Honey Farms, trading as Coorgam Naturals (“we”, “us”, “our”, “the Company”), governing your access to and use of the Website at www.coorgamnaturals.com and any purchase of products therefrom.

By accessing, browsing, or using the Website in any manner, you unconditionally agree to be bound by these Terms, our Privacy Policy, Shipping Policy, Refund and Cancellation Policy, and Disclaimer, all of which are incorporated herein by reference. If you do not agree to any of these Terms, you must immediately discontinue use of the Website.

These Terms shall be construed and governed in accordance with the laws of India, including but not limited to the Indian Contract Act, 1872, the Sale of Goods Act, 1930, the Consumer Protection Act, 2019, the Food Safety and Standards Act, 2006, the Information Technology Act, 2000, and the rules framed thereunder.

2. Eligibility

Use of the Website is available only to persons who are competent to contract under the Indian Contract Act, 1872. Persons who are minors (below 18 years of age), undischarged insolvents, or otherwise disqualified from entering into contracts are not eligible to transact on the Website. By placing an order, you represent and warrant that you are at least 18 years of age and legally competent to enter into a binding contract.

Where a User places an order on behalf of a legal entity such as a partnership, company, or trust, such User represents that they have authority to bind that entity to these Terms.

3. Products and Product Information

3.1 FSSAI Compliance

All food products listed on the Website are manufactured and/or packed under FSSAI License No. 23625030006421. Product labels, ingredient lists, and nutritional information are provided as per applicable food safety regulations.

3.2 Product Descriptions

We endeavour to describe our products accurately. However, we do not warrant that product descriptions, images, weights, or other content on the Website are completely accurate, current, or error-free. Natural products such as honey may exhibit variation in colour, consistency, crystallisation, or flavour between batches — such variation is inherent to raw, unprocessed natural products and does not constitute a defect.

3.3 Availability

All products are subject to availability. We reserve the right to discontinue any product without notice. Where a product ordered is unavailable, we will notify you and offer a refund or substitute, at our discretion.

4. Pricing and Payment

All prices displayed on the Website are in Indian Rupees (INR) and are inclusive of applicable taxes unless expressly stated otherwise. Prices are subject to change without notice. The price applicable to your order shall be the price displayed at the time of placement of your order.

Payments are processed through Razorpay Payment Gateway. We accept UPI, debit cards, credit cards, net banking, and other modes enabled by Razorpay from time to time. By making a payment, you agree to Razorpay’s terms of service. We do not store your payment credentials. We shall not be liable for any payment failure, fraud, or unauthorized transaction arising from your use of the payment gateway.

In the event of a pricing error on the Website, we reserve the right to cancel the order and refund the amount paid, without any further liability.

5. Order Placement and Confirmation

An order placed by you constitutes an offer to purchase products at the listed price. No contract is formed until we accept your order and issue an order confirmation. We reserve the right to refuse, cancel, or limit any order at our sole discretion, including but not limited to cases of suspected fraud, multiple orders from the same address beyond reasonable limits, or unavailability of the product.

Order confirmation shall be communicated to you by email or WhatsApp. You are responsible for providing accurate delivery information. We shall bear no liability for non-delivery or delay arising from inaccurate or incomplete delivery addresses provided by you.

6. Intellectual Property

All content on the Website including but not limited to the Coorgam Naturals name, logo, taglines, product images, photographs, copy, descriptions, and website design are the exclusive intellectual property of Arjun Nirvana Honey Farms or its licensors and are protected under the Trade Marks Act, 1999, the Copyright Act, 1957, and applicable international intellectual property conventions.

No part of the Website content may be copied, reproduced, modified, published, uploaded, posted, transmitted, distributed, or used for any commercial purpose without our prior written consent. Unauthorised use may give rise to civil and criminal liability.

User-generated content such as reviews and testimonials submitted by you shall be deemed to be licensed to us on a non-exclusive, royalty-free, perpetual basis for use in our marketing and promotional materials, unless you expressly request otherwise in writing.

7. Prohibited Conduct

You agree not to:

Use the Website for any unlawful purpose or in violation of applicable law
Impersonate any person or entity or falsely represent your affiliation with any person or entity
Submit false, fraudulent, or misleading information including fake reviews or testimonials
Attempt to gain unauthorised access to any part of the Website or its server infrastructure
Use automated means including bots or scrapers to extract data from the Website
Transmit any virus, malware, or other harmful code through the Website
Engage in any conduct that disrupts, degrades, or interferes with the functioning of the Website
Resell products purchased from the Website under a different brand or label without our written consent

8. Disclaimer of Warranties

The Website and its content are provided on an “as is” and “as available” basis without any warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. While our products are FSSAI certified and lab tested, we do not warrant that consumption of any product will produce any specific health outcome. Statements on the Website regarding health benefits are general in nature and are not intended as medical advice. Users with specific health conditions are advised to consult a qualified medical professional before consumption.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Arjun Nirvana Honey Farms and its proprietor, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business opportunity, arising out of or in connection with your use of the Website or purchase of products, even if advised of the possibility of such damages.

Our aggregate liability to you for any claim arising out of or related to these Terms or any order shall not exceed the amount actually paid by you for the product giving rise to the claim.

Nothing in these Terms shall limit liability for fraud, death, or personal injury caused by our negligence, or any other liability that cannot be excluded under applicable law including the Consumer Protection Act, 2019.

10. Force Majeure

We shall not be liable for any failure or delay in performance of our obligations under these Terms arising out of circumstances beyond our reasonable control, including but not limited to acts of God, floods, fire, pandemics, government orders, labour disputes, supply chain disruptions, or failures of third-party service providers.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of India. Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall first be subject to good faith negotiations between the parties.

If the dispute is not resolved through negotiation within thirty (30) days, it shall be referred to arbitration in accordance with the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Hyderabad, Telangana. The language of arbitration shall be English. The award shall be final and binding.

Notwithstanding the foregoing, nothing shall prevent us from seeking injunctive or other equitable relief before a competent court for protection of intellectual property or prevention of irreparable harm. Subject to the above, the courts at Hyderabad, Telangana shall have exclusive jurisdiction.

12. Amendments

We reserve the right to modify these Terms at any time. Amended Terms will be posted on the Website with an updated effective date. Your continued use of the Website after posting of amended Terms shall constitute your acceptance thereof.

13. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a competent authority, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

These Terms, together with the Privacy Policy, Shipping Policy, Refund and Cancellation Policy, and Disclaimer, constitute the entire agreement between you and us with respect to your use of the Website and supersede all prior agreements and understandings.
